TOPIC: Not Allowed to Resign

Not Allowed to Resign 4 years 11 months ago #16009

I hope anyone can give me some answers about my problem. I have a contract which is a fixed-term for 2 years. It'll be ending this April 2016. I have submitted a resignation letter last July 29 but it was rejected. The owner said I am bound with a contract to the company. In the contract, there's a stipulation:

Employment Bond/Prohibition for Pre-termination.
There's a statement here that the employee cannot preterminate the contract, that includes resignation.

Is this legal? Should they force me to work even if I don't like it anymore?

Well. they've allowed me to resign if I would pay 30k for Breach of Contract.

By the way, they haven't trained me for anything, and haven't had spent money or time for my training. Also, I am not considered a regular employee but I do have the same benefits as them like sss, phil health, and pagibig.

You can resign anytime you want, but of course, you will be liable for damages because of breach of contract. With the amount of damages, if you do not agree on the amount, they have to file a case in court to fix the amount of damages.
