Hi Atty. Libayan!

Good day sir!

I'm writing an email to you in behalf of my close friend. Anyway, his case is that he works on a 5-star Hotel as a Vallet Parking Driver/Attendant, he was already employed with them for 10months. Last week, his supervisor announced that there will be random drug check and if someone is part of it, they will receive a text message. My friend didn't receive any messages on that week, however, when he went back to work, his ID access is no longer valid and he is showing in the records that he was terminated due to Drug-related violation. So, what he did is that he went on to his agency's office and ask the reason why, and indeed, it showed that he was part of the group that got terminated. What he did was that he immediately take a drug test thru a third party clinic, which resulted to negative and kept the records. He never received any written documents regarding his termination, and his salary was put on hold by the employer as well.

My question is, what cases can he file thru DOLE? If ever, can he file Libelous claims also against the employer as there were a lot of people knew what happened and sees the guy as a drug abuser? Also, how much damages can he file against them?

Pwede siya mag file ng illegal termination sa DOLE.

Depende sa circumstances kung paano kinalat ang information. Pwede maging libel o kaya slander.
