Dear Sir,


It is about my ex-employee. She is our former president. She resigned on the 28 Jan 2016. The reason she was asked to resign is because she is not performing and our organization having huge-losses. We pay separation fee, last salary and 13month salary for her resignation.

We had just found out with our foreign principals (clients) that she make her own personal deal with them, asking for commission, agency fees / processing fees to deposit to her own account instead of Company account. We have the agreement provided by our client which can prove “she asked for the fees to deposit to her own account.”

My question is:-

1. Since she already resign, can the company take legal action against her?
2. Or What action should we consider to take against her? To report to police or labor office?
3. Can we ask her to compensate the company losses due to her wrongdoing and “criminal breach of trust” during her appointment as president in the company?
