Hello, Atty Libayan,

I was with [24]7 Customer Philippines, Inc., a BPO company based in Makati City from April 2015 up until May 17, 2016, when the Company dismissed me from the roster of their employees, citing Absence Without Leave as ground for termination. I did not receive any notice from them notifying me of the offense committed and the schedule of an administrative hearing. According to the correspondence that I have received on May 19, 2016, the said hearing was scheduled dated May 16, 2016 and the decision was made final a day after. As far as I know, under the due process clause of Section 1, Article III of the Constitution, the Company is liable because they have failed to observe procedural due process, in accordance to what the Labor Code prescribes. Also, I can question the decision of termination because of this. What steps can I take to have the decision expunge from my record and what are the remedies that I can resort to?
