ILLEGAL DISMISSAL 3 years 4 months ago #17080

Dear Atty. Libayan,

Good afternoon, I consult ko lng po case ko sa inyo, almost 5 yrs npo ako sa company na pinapasukan ko, may inissue sa aken na notice to explain regading sa mga violations ko sa company policy , 8 counts of violation po ang ikina kaso sa aken. Tinanggap kopo written notice sa aken to explain my side and then forward ko agad ung explanation ko. inissue sa aken ung wrtiien explanation notice April 29, 2016 and submit kopa s kanila May 2, 2016 pero nag decisyon agad at nag issue agad ng termination notice ung HR Manager May 5, 2016. Na bigla po ako dahil as far as I know dapat po my admin hearing pa yon at nag request ako ng admin hearing pero hindi nman ako pinag bigyan sabi HR Mnager d na daw kailanagn. sa tingin ko may mali po sa procedure na ginawa sa akin i was illegally dismissed.

Ngayon, nag reklamo po ako sa NLRC banawe, may mga schedule npo kmi na atenand sa SENA at ngayon sa Arbiter na this coming July 19, 2016 po 2nd hearing ko pero parang ginigipit ako ng company ko. eto po mga complain ko:

Illegal Dismissal
Non payment of Salary, 13th month, Pension Plan, SL / VL, Holiday pay
Non payment of separation pay
Payment for moral and exemplary damages,
Constructive Dismissal
Illegal Deduction from my salary - mau deduction sila sa aken sa telephone bill na sobra sobra na

Gusto kopa ituloy case ko sa kanila kasi naniniwa ako na may karapatan ako, during nung akoy na dismissed sobra naawa ko sa sarili ko nag aaral po anak ko ako lng nagtatrabaho sa amin ako lng inaasan ng familya ko tapos wala nko trabaho. Sa akin paniniwal hindi po tama decisyon ng TERMINATION dapat nag deliberate muna sila bago nag decisyon kasi agad agad n tinanggal ako wala man lng consultation sa Management.

During po na ini issue sa aken ung termination notice binasa kopo muna pero ng refused to signed po ako hindi ko ni recieved notice of termination pero humingi po ako ng copy subalit hindi ako binigyan. Sabi HR Manager hindi daw po ako bibigyan ng copy if dko irerecieved. Gusto kopo humingi ng tulong s inyo para maliwanang po ako sa kaso ko. tulongan nyo po ako atty.
