Hello Sirs,

Lumalapit po sana ako sa inyo para humingi ng payo. Ang sumusunod ay ilan lamang sa violations at unfair/inhumane practices ng aking last employer (with less than 15 employees):

1. Ang aking sahod sa first 5 days ko na tinuturing na training ay P300.00 per day lamang.
2. Matapos nito ay naging P290.00 per day na lamang po after the 5-day training.
3. Pagkaraan ng halos dalawang buwan ay tinaasan po ako ng employer ko at naging P310.00 per day.
4. Wala pong kontratang pinirmahan.
5. Walang statutory benefits tulad ng SSS, Pag-ibig at Philhealth.
6. Wala pong holiday pay at night differential.
7. Nagkakaltas sya ng P325.00 sa kada sahod na tinatawag niyang "bond" para sa anumang maaari naming masira sa laundry shop.
8. 12-hours po ang shift namin.
9. Kapag lumampas kami sa 12 hours, may OT pay na P35.00 lamang per hour.
10. May CAP po ang OT namin at kapag lumampas kami ng 10 hours OT sa isang cut-off period (15 days) ay di na niya ito babayaran.
11. Hindi po maayos ang proseso ng kompanya mula sa pagtanggap ng laundry hanggang sa pag-deliver nito kaya po madalas ay ako, bilang taga-pick-up at taga-deliver ay napagbubuntunan, at minsan ay namumura pa, ng mga customer. Makailang beses na rin naming idinaing ito sa aming employer pero wala pong nangyari. Kanya-kanya po ang mga empleyado kung anong proseso ang gusto nila gawin.

Nagpa-NLRC po ako at ayaw po nilang bayaran ang mga inirereklamo ko. Ang rason nila ay:

1. Field employee daw po ako kaya daw po ganoon ang sahod ko. Ganoon din naman po ang sahod ng lahat, kahit mga taga-laba. Totoo po, lumalabas ako dahil yun po ang trabaho ko, ang magpick-up at magdeliver ng laundry. Pero bukod po dun ay naglilinis po ako sa shop, nagtutupi at nagre-receptionist. Ano po ba ang batayan ng pagiging "field" employee?
2. Less than 15 employees daw po kami kaya hindi po minumum (P491.00). Hindi naman po talaga P491.00 pero di po ba P450.00 ang nasa batas na dapat na minimum wage para sa companies na may 15 & below employees?

Sana po ay mapayuhan niyo ako dahil kahit ang mediator ay pinag-aareglo ako sa napakababang halaga kahit alam niyang hindi ito ang naaayon sa batas.
