Good morning Atty, I hope it is okay. May question lang po kasi ako about our work. I am working as company driver for Oriental Group in Solaire. My question lang po Atty is since we are being paid minimum which 491.00, is it still deductible for the 1-hour lunch break? Last cut off lang po namin napansin na meron kaming deduction na UNDERTIME for 720 hours but when I talked to the personnel department they told me para daw yun sa 1 hr na lunch break every duty. Just to give you some details Atty para po hindi masyadong malabo sa inyo yung situaiton namin, I was hired as company driver last Dec 2016 pero wala silang pinapirmahan na probationary contract. meron lang sila pinapirmahan nitong feb or march na oo ata yun. and based sa natatandaan ko our salary was fixed something around 12,000 plus every cut off or 15 days. pero sa payroll namin ang nakalagay na sweldo is 491.00. we are working or on duty for 24 hours. let's say pasok po ako ng 7:00 am today then ang out ko is 7:00 am na rin tomorrow after that rest day ko na and then cycle na po yun. Naguguluhan po kami kasi 8 hours ang usapan naming trabaho then the rest of the hours sa isang shift namin na 12 hours ay overtime na. tama po ba na kung 12 hours ang isang shift namin ang 8 hours is the regular working hours then the rest at overtime na? Dapat po diba I start at 7am then it should end at 7 pm and dun na mag start ang another shift. Kasi nung holday po ng april 9 and 13 ay 30% lang ang binigay nila sa amin na holiday pay dahil pumasok daw po kami ng april 8 7am and nag end ang shift namin ng 12 midnight so 6 hours lang ang working hours namin nung april 9 which is from 12midnight to 7 am.
