Hi, I would just like to consult if I have grounds to file for constructive dismissal on my previous employer. I resigned from the said company last October 2015.

I was working as a staff level technical employee and reporting directly to a department manager. I worked my way to this level from 2 levels below for 7 years in the same company. Then came an org change inside our department in 2015. Though our department is still intact, I was transferred to a different department on a lower level position, my boss said my skills fit more on that department after they deliberated for the org change.

Though my salary and job grade didn't change, I'm again back to a role where it is an obvious demotion from my previous role. I am very upset on what happened and look for another job right away. I had a final discussion with the department manager from the department where I was transferred before I resigned. I told him that I have an offer from a different company for a staff technical position (same level as supposed to be) and was really demoralized of the transfer and demotion that happened. He explained to me that he cannot put me right away into that kind of position as I am new to their department, and I need to start from the given position which is lower. Then I resigned after that discussion and rendered 30 days knowledge transfer.

Would really appreciate your professional advise regarding this matter, thank you very much.

Demotion definitely is illegal and it may result to constructive dismissal.
