GOOD day Atty.

my name is ruel working in a call center as a regular employee at Ortigas. Hope you can help me and give me legal advice.,what happened was our company conducted our Annual Physical Examination dated July 2012 and every employee should undergo this APE.,last March 2013 my immidiate supervisor called my attention. hindi ko pa alam kung ano po yung dahilan Atty. kung bakit ako pinatawag at agaran nya akong pinapunta sa HR manager ng kumpanya namin..at dun ko lang po nalaman nung pagpunta ko sa HR manager last March 2013, sinabi po sakin ng HR manager namin na may sakit po ako, positive po ako PTB..Atty, tumawag po ako sa health clinic na nagconduct ng physical exam namin., August 3,2012 pa po naisubmit sa kumpanya namin yun result ng med exam..tinanong ko po yung kumpanya ko kung bakit lumipas ang maraming buwan pero hindi po nila sinabi sakin agad na may sakit akong nakakahawa, pagkasabi sakin na may sakin ako nagpachech up ako last week ng march nagpositive po na may sakit ako nung malaman ko po yun minabuti ko na rin pong ipasuri ang aking asawa at anak,parehas po silang nagpositibo na may sakit na rin at sa kasalukuyan pare pareho po kaming nagmemedikasyon pero po ako ay nakabukod at nasa pamilya ko po dahil nakiusap sakin yung magulang ng asawa ko na umalis muna ako habang nagpapagaling dahil po mahina ang kanyang resistensya gawa ng siya po ay nag undergo ng bypass...

tanong ko po attorney may pananagutan po ba sakin yung employer ko dahil pumapasok parin ako kahit ako ay unfit?
- ako po ay inabisuhan nila na may nakakahawang sakit (PTB) ilang buwan ang lumipas pagkatapos ng APE
APE july 2012 - March 2013 sinabi nila na may sakit ako

- August 3, 2012 ipinasa ng partner clinic yung medical result sa kumpanya namin

Atty. gusto ko pong malaman kung valid po ang complain ko?
Ano pong kaso ang pwede kong ihain sa aking kumpanya?

Ang ibig ko pong sabihin atty. aware po ang aking Kumpanya na ako ay unfit na dahil po ako ay may PTB., yung Annual Physical Exam po namin ay ginanap noong July 2012 at naipasa na po nung medical clinic na nagconduct ng APE yung result August 3,2012 pero ininform po ako ng HR namin na may sakit ako March 2013...lumilipas po ang mga buwan na ako ay pumapasok parin na dapat sana ako ay nagpapagaling..6 months po ang gamutan ng sakit ko sabi ng pulmonologist ko,na di sana ay kung ininform nila ako hinggil sa estado ng aking kalusugan magaling na po sana ako ngayon at hindi nagpapagaling pa lang..At dahil po hindi ako aware na may sakit ako dahil wala naman po nabanggit sakin tungkol sa resulta ng medical exam ko na nitong huli sinabi sakin.,pinasuri ko po ang aking mag ina..nagpositibo po sa skin test ang asawa ko at ang anak ko naman na babae na ngayon at 1taon at 4 na buwan gulang ay nagpositibo rin sa xray at skin test sa sakit na meron ako ngayon..tanong ko po Atty. valid po ba ang aking reklamo patungkol sa pagbabaya ng kumpanya ko hinggil sa hindi agad pagsasabi sakin o pag inform patungkol sa estado ng aking kalusugan gayung sila ay nagconduct ng Annual Physical Exam, napakahirap po sa sitwasyon ko ngayon tatlo kaming nagmemedikasyon ng mag ina ko...tama po na sa pahanong natanggap na ng kumpanya ko yung resulta ng medical examination ko na ako ay unfit pala sa kadahilanang ako ay may PTB, pinapapasok parin ako??

Kung unfit ka nga sa trabaho, sa tingin ko ang magdedecide nyan ay ang employer mo. Nalilito ako, hindi ba dapat ay matuwa ka dahil di ka tinanggal sa trabaho at may kinukuhanan ka pa ng araw araw na pang-gastos nyo?

Ang gusto mo ba ay tanggalin ka sa trabaho? Kung sa tingin mo yun ang tama, marapatin na mag resign ka na lang o kaya mag leave.

atty., ano po ba yung dapat kong ikatuwa doon eh pinalipas nila yung maraming buwan na hindi nila sinabi sakin na may sakit na pala akong nakakahawa(PTB) hindi po ba DAPAT agaran nilang pinaalam sakin na may sakit ako na sana ngayon ay magaling na ako at hindi nagpapagaling pa lang...regular na empleyado po ako at alam ko rin yung mga benepisyo ko..Ang nirereklamo ko ay yung kapabayaan nung kumpanya ko dahil nagconduct sila ng Annual Physical Examination noong July 2012 at ipinasa sa kanila ng partner nila Medical clinic yung resulta ng medical exam noong Agosto 3,2012 pero noong March 2013 lang nila sinabi na ako ay may sakit na..I-tama nyo po ako kung ako ay nagkakamali patungkol po dun sa nabasa ko rule 1960 po ng health safety..classified po ako as D unfit to work for any job.,Ang gusto kong ireklamo ay yung HINDI pagsasabi sa akin agad ng employer ko na ako ay may sakit na gayung ilang buwan na palang alam nila na ako ay may sakit nang nakakahawa...
