I am writing to you to address my concern regarding our lot title, which we think still have not been registered to the name of my father and my uncle (My father's brother). Until my mom discovered something, when the DENR went to our Municipal to offer an affordable service relating to Land Title (those that does have title yet).
Since, they allow the people to check in the book of land registration my mom was able to check our land area and to her surprised she found out that the name of the owner is not the original owner whom my father and uncle bought the land. The whole land/lot area size is 917sqm whereas, the 600sqm was now claimed and named to my uncle while the remaining 317sqm (this seems the lot area of our house) is left untitled. But this supposedly should have been divided equally into two because that is the agreement of my father and my uncle (as advised by our mom). Family members from both sides knew that. The thing now is we tried to ask to his eldest daughter if they can find deed of sale from his fathers documents and she replied that there is no paper like that. We do not know if they are aware of their father's fraud action he did to my father. We also do not know when was the time my uncle did the transfer of title to his name and where did he got the documents because as for all we know the land owner was deceased and the original title was no longer found even the land owner's family member cannot be found. That is a big question to our mind.
Appreciate if you could give us information on the next action or steps we should be doing. Because my mom really felt bad about what our uncle did. By the way my uncle was deceased already 2 years ago. And his family seems mum about the land title matter. They even advised that they are not yet interested in applying for title.
Do we still have chance to correct the title as I mentioned it should be divided into 2(TWO) or equally divided?
Where do we go first for verification of the land title?
We only have tax declaration still named on the original owner not yet the name of my father.
