Atty, thanks for this forum, where I could ventilate my problem believing that with your legal advice, it can also help those who are in the same situation. Here are the facts:

I bought a 200 - sqm meter residential property for a minimal amount here in Calinan, Davao City. Being a neighbor, I trusted her, so that I agreed immediately to enter into agreement verbally that I have to pay only half of the price and my neighbor to process the title in my name and I to pay the remaining balance upon presentation of title. Having paid half of the price, I demanded that a Deed of Absolute Sale be executed and I will volunteer to do the processing. Upon presentation of the title,I found out that the title is in the name of her mother who had been now where to be found for the last 40 years. She left the home with another man, and from then, they never had any communication.. Her all 6 children and their old father wanted to divide the property among the 6 children and to segregate also the portion that I bought. They agreed to set aside equal portion for their mother just in case she will return. Is this feasible under the facts narrated. How much will it cost now to petition the court that the wife is presumed dead so that they can now divide her property.Note-The mother is the owner of the said property as this was her share from her mother(lola of the children)ROAD
