Hello Atty. Libayan!

Here I am again.

I hope you will not get tired of my asking your legal assistance.

Pasensya na rin po if I am sending this query this late.
-
In the 2009 Judgement via Compromise Agreement, the main condition is that the plaintiffs get a share of 1/4 for every property especially the lots. Three fourths of the property go to the defendants. However, there is an exception because the lot where the residential house was situated will be owned by the defendants and the supposed 1/4 share of the plaintiffs will be paid cash or through giving them a part of another lot equal to their 1/4 residential lot share. During the survey in 2010, which was the execution of the subdivision of lots, it was verbally agreed that the 1/4 share of the lot be given to them instead because one of the plaintiffs wanted the cash on the spot. So, we just agreed to give it to them which was against our will because we didn't have the money yet. He was violent at that time.
Now, we realize the sentimental value of the said lot and we want to get it back. Anyway, it was just a verbal agreement. The plaintiffs have recently put a fence around the said 1/4 share. We still have the original Title of the whole lot though.

My question is:

Can we get it back considering that the survey has been done due to one of the plaintiffs' cash demands which we could not comply? Such act was not in coordination with/to the Compromise Agreement. It was just the result of an impulsive verbal decision.

Please help.

Thank you so much.

Grateful Grace

You have to talk to them if they agree. If they do not, you cannot do anything because you are bound by the consequences of your actions.
