I am a resident of the Philippines for 19 years and an Australian citizen. I was divorced in Australia in 2013 and wish to remarry. I presented to the Bacoor civil registry and was told that the CENOMAR indicates I am married still to my ex and therefore need to go to the Local Regional Trial Court to file a case to get a Certificate of recognition for the NSO. So I went to the Bacoor LRTC and spoke to an attorney and she told me the following
1. The law enacted IS NOT APPLICABLE to m,e the foreigner only to the Filipino.
2. I am able to get married as the divorce IS RECOGNISED here but the Filipino cannot get married until he or she files a case for recognition.
3. I showed her the Divorce papers and the Embassy issued Certificate of No Impediment and was told that is all I needed.

But the problem is that to get a marriage licence from the Civil registry in bacoor I need a CENOMAR and herein lies the problem.
The law failed to address the issue of the foreigner wanting to remarry a Filipino. I may add I never required a CENOMAR when I was originally married in Bacoor before.

My question is what can I do? What is the avenue I must take to rectify the problem. How do I get a marriage licence if my ex wife doesn't want to remarry and file the divorce papers.

Just to add to my intial post, if I require a CENOMAR and as the Attorney told me the Law isn't applicable to me per se, then I cannot remarry until my ex files a case and if she doesn't file a case then I can NEVER re marry. There must be an avenue for the foreigner to change his status
