Hi Atty. Libayan,

I have a problem with my birth certificate, it has many clerical errors. First is about my name, I'm using CHAREO, but when I checked my birth certificate record, my name indicated is CHARIO (with an "I" not an "E"). I tried having it corrected in Manila Civil Registry, but when they checked my Birth Certificate, there were multiple wrong entries found by the reviewer, which are follows:

1. Spelling of my name, it's CHARIO in the Birth Certificate, and I'm using CHAREO in all of my documents like SSS, School Records, PagIBIG, TIN, etc.
2. Middle names of my parents (my Father's middle name indicated was Cruz, were it should be Dela Cruz; and for my Mother's middle name, the one indicated was OngEng, were it should be Uy)
3. Parent Birth Place (my Father and mother's birth place information indicated was their birth dates, not their birth places)
4. Marriage Date of my Parents is also incorrect.

When I got the required lists of needed supporting documents from the Civil Registry, I cannot provide the supporting documents to correct the corrections for numbers 2 and 3 because I cannot obtain any records of my parents, both have no records of their birth certificates in their place of birth and no baptismal records for the reason that their records were destroyed during the War (World War II).

I don't know what to do anymore, when I asked the representative from the Manila Civil Registry for any options on how to correct the clerical errors, they just said to me that if I cannot provide the supporting documents, what I need is Court Order, which I cannot afford because it is very expensive :( .

I hope you can provide me some advise on how can I correct all of the clerical errors, or if it is possible, to correct only my misspelled name since both of my parents were already deceased.

If you do not have supporting documents pertaining to 2 and 3. how did you know that they were wrong? Is it possible that those were the correct entries?

Since 2 and 3 are not significant to you anymore, just proceed with the rectifying of your name. It is ok if for the mean time, you just correct entries your name.

Thank you so much for your reply. Actually, I got a copy of the Marriage Certificate of my parents, and based on the information indicated in the Marriage certificate, they (Civil Registry personnel) said that the middle names of my parents should follow the entries indicated in their marriage certificate. and for #3, the person who filled up my birth certificate wrote my parents birth dates, instead of birth place, and the civil registry wants to correct have it corrected also.

Is there any other way that I can correct my mis-spelled name only? because the Manila Civil Registry personnel were very strict, they dont allow to correct only my name, they want me to correct all the wrong entries in my birth certificate. :(

Yes. Now, you do not need to go to court to correct those misspelled entries. Just comply with the requirements of the LCR.
