Good Day!

Hi, I am a single mother, but my child is carrying his father's surname. I agreed to do so, at first, thinking that he would be a responsible father to our son, even we are not married. He signed the birth certificate. But after 8mos, he was gone. I have no idea of his whereabouts. My son is now 8yrs old, and no father appeared. Just wanted to ask if there is a way that I can change my son's name to my surname, instead of his father's. I don't want my son to have any connection to that name anymore, and I'm worried that my son is growing knowing no relative from his father's side. Up til now, no communication was made by the father.

Thanks a lot. I have consulted other lawyers before and was advised not to change due to the child's rights...maybe they are referring to a possible inheritance. But I'm not after it really. Follow-up question lang po....this petition to change his name in the family court, does this require any father's consent (which will be difficult for me to get since we have no communication)? And how do I file such? Can I request for a process flow and requirements for this? Thanks a lot.

Even if the child has a different surname, as long as proof of paternity is established, the illegitimate child can still inherit.

The father may oppose it if he wishes but the change will still depend on the grounds you have if it is meritorious.

I suggest you contact a lawyer and do not bother yourself with the process and the requirements. There is a reason why you need a lawyer for this.
