Good Evening atty.,
1). umupa po ako ng bahay with contract noong March 2010 at hanggang ngayon dito ako nakatira, hiningian po ako ng 1 month advance and 2 months deposit. At humingi din po ng Utility deposit worth P10,000. Naayon po ba sa Rental Act of 2009 ang paghingi ng utility deposit kahit na isinama ito sa contract?

2). Noong 2012, may malaking daga po na namatay sa kisame ng 2nd floor na di namin namalayan, habang natutulog po kami ay pumatak po sa mukha at katawan naming mag asawa yung mga uod mula kisame, nireklamo po namin iyon ngunit inasikaso po nila matapos ang 1 month and 3 weeks na pag aantay, meaning 1 month and 3 weeks kaming mag asawa natulog sa baba sa sofa. Makatarungan po ba ito? Ano po ang pwedeng gawin?

3). Noong August 2013 tumulo po yung bubong ng bahay at kumalat po sa kisame at nasira yung aking energy saving lights. Tumawag po ako sa office ng lessor at sinabi na may tulo ang bubong, pinangakuan lang ako na magpapadala ng maintenance pero inabot na po ng katapusan ng December 2013 eh walang maintenance na dumating. Nagdusa po ako sa lahat ng bagyong nag daan noong 2013. Noong February 2014 nag decide na lang ako bumili ng condo, sa pag aayos ng papeles inabot kami ng March 2014, irenovate po ang condo this April and May 2014. Hanggang umabot po ng finish contract ko nitong March 31, 2014 wala pa rin pong aksyon at sabi wala daw sila maintenance. Di na po ako pumirma ng kontrata since I will only stay for another 2 months. Since sila naman ang dahilan kung bakit ako aalis dahil sa kanilang kapabayaan. Pinipilit po nila ako pumirma dahil di daw pwede mag stay sa paupahan nila pag walang kontrata ipa padlock daw yung bahay. Wala po akong utang sa rent at utilities. Ano po ang Masasabi nyo dito?

4). Dahil sa pagmamadali ko sa pagpirma ng kontrata before di ko napansin na pati pintura ng bahay na subject to norman wear and tear eh pinasasagot ng lessor. Tama po ba na pati pintura eh ako magbabayad? Constitutional po ba ito?

1. Kung nasa kontrata po ninyo yan ay pwede po kasi may freedom to contract po kayo. Pwede po na hueag po kayo magbigay kung wala po kayong ganyang kasunduan.

2. Hindi po talaga makatarungan yan. Ayon po sa civil code, pwede niyo pong huwag muna kayo mag bayad ng renta hanggang hindi po nasasatisfy ng nagpaupa ang mga obligasyon niya para sa mapayapang pag tira niyo sa bahay.

3. Hindi po pwedeng ipadlock yung bahay. Illegal yun at pwede silang makulong sa salang grave coercion.

4. Depende po sa kasunduan yan. Wala naman po specific provision ang constitution sa pintura ng bahay. Nasa parties po ang malayang pag lagay sa kontrata ng mga kondisyon.

Di po ba ang pintura sa loob ng bahay eh subject to wear and tear? Pati po ba yun sagot ng lessee?
