Good afternoon Attorney. My Lola passed away in November 2015. She was receiving 24,000Php pension from PVAO thru a LandBank passbook account. In December 2015, my Mom (my Lola's daughter) submitted her death certificate directly to PVAO to advice them of her death. On the same month they still received pension on the account. My Mom who has SPA to withdraw from the account, withdrew the money. After that, she did not expect any more pension to be credited to the account. Now after 6 months or so, People who say they are from Land Bank calls my Mom after banking hours and tells her she needs to pay for 58,000Php because the Land Bank account was still credited December and January. The SPA is very specific only to withdraw money on the pensionnaire's behalf. Does the bank have the right to ask my Mom to pay them back what was withdrawn? And what is the best way to question why they are asking for the whole amount instead of just the one month that was withdrawn?
