itong property ay nabili po namin by 3years installment.ang huling bayad ay noong July 2009. ngunit hanggang ngayon ay hindi pa ma-i transfer ang property, dahil, hindi pa nakapagbayad ang nabilhan namin sa bangko.
lumipas ang sunod-sunod na promise na mabayaran na niya sa bangko,pero, palaging may mga dahilan na sinasabi... kaya umabot sa ngayon.
-kung maforeclosed po ba ang property ng bangko ay may habol at paraan po ba kami.
-may time limit po ba ang mortgage, bago magdecide ang bangko for foreclosure.

dahil sa friend sila ng bangko, hanggang ngayon ay hindi ito na foreclosed. ito ang pinagmalaki niya. at sabi niya gusto niyang matapos din ito sa madali, dahil nagbabayad siya ng interest sa bangko buwan-buwan.

kaya sa tagal na panahon ay nagsuspect kami na may special term dito. na baka mabulaga na lang kami na walang kalabanlaban.

Good day Isaias,

First things first, you have to look into the title of the property so you will know who owns it and what is its liens and encumbrances. I have clients who were fooled into thinking that the property is still clean or is still the debtors property but upon inspection of the title, it is no longer the debtors property or worse, it was never the debtor's. A mortgaged property can still be subject of a sale; HINDI PO DAHILAN ANG HINDI PAGBAYAD NG MAY-ARI SA PINAG-SANGLAAN NG LUPA PARA HINDI MAI-TRANSFER ANG TITULO SA PANGALAN NG BUMILI. Kahit nakasanla and lupa at hindi ito nabayaran, pwede pa rin i transfer and pangalan sa bagong may ari. Ang bagong may ari ngayon ang pwedeng habulin ng Banko kung sakali.

If ever the property will be foreclosed by the Bank, and only if the Title has been transferred to your name, then you will be privy to the mortgage.

However, if the property is not transferred to your name, all you have is a civil case against the seller. Or, if you really are interested in the property, you can join the foreclosure sale and you can buy the property from there. Yung lupa na po ay mapupunta sa buyer in a public auction.

Every mortgage has a maturity period, depending on the parties. So, if that period arrives, the mortgagee can foreclose the property after that stipulated period.

I suspect foul play here so I suggest you investigate immediately bago pa mawala lahat sa inyo.
