TOPIC: threat

threat 4 years 3 months ago #16830

my fiance had an argument with his supervisor (woman) due to her neglegence of not submitting his timesheet on time to get his salary. due to outburst of emotion he texted foul words(pagmumura) and according to the supervisor there was threat or she feel threatened. now the company gave my fiance a notice to explain on what he texted to his supervisor. I'd like to ask if we can counter her complaint as to which the reason why my fiance said those words or texted is because of the gross negligence of duty that her supervisor did. how can we deal with it? I saw this article in here:

3. But if the threat was made in the heat of anger and the accused did not persist, it is Light Threats. E.g: In a heated quarrel the accused uttered: “ Uubusin ko kayong magpapamilya” but did not do anything more. If he however gets a weapon and moves towards his opponent, the crime is grave threats.

please help me. thanks
